Filing a Complaint with OSHA
You can file a complaint if any of the following occur as grounds for an OSHA citation:
- A hard copy of the Exposure Control Plan is not made available upon request to employees or their representatives with 15 working days.
- The Exposure Control Plan is not reviewed and updated annually, and more frequently whenever new or modified procedures are adopted and/or whenever employee positions are revised to create new potential exposures.
- The annual review of the Exposure Control Plan does not include review of the most recent technological advances.
- Needleless or shielded needle IV line access products are not provided.
- Safer needles and other sharps with integrated safety features are not used in all of the following categories:
- syringes (retractable or protective sheaths)
- blood collection devices (retractable, self-blunting or sheathing)
- IV access products (retractable needle)
- lancets (retractable)
- blunt surgical needles where medically appropriate
- safer scalpels
- Purchasing decisions are based on the least expensive option as opposed to the safest and most effective.
- Frontline health care workers do not receive training on the use of safer devices or training in which:
- the person conducting the training is knowledgeable
- the training is interactive, allowing for questions and answers with the person conducting the training sessions
- workers are trained about the location of the Exposure Control Plan and procedures to follow if an exposure occurs.
ANA recommends that you work with your employer to implement the changes required to protect health care workers and to comply with the Bloodborne Pathogens Standard.
